By accepting Hostenol's Terms of Service, you also consent to our Privacy Notice and Data Use Policy. Please take a look for more information on our Privacy Notice and Data Use Policy.

All customers of Hostenol, who sign up for taking Hostenol web hosting services, accept to comply with Hostenol Terms of Service (TOS). The vision of the TOS is to assure customers are using Hostenol services with due respect to the preferences of other internet users and in compliance with the specifications of the Hostenol network conditions. The terms are not exhaustive, and Hostenol holds the right to add, delete, or change any prerequisite of its TOS at any time without notification, effective upon either posting the revised TOS to www.hostenol.com or information of the modified TOS. Any objections about a customer's violation of the TOS will need to be sent to abuse@hostenol.com. Please take a look at our abuse terms below for more details on the abuse policy. When you conform to the terms, you also agree to our billing terms. Except when expressly consented to the contrary in writing by an empowered representative of Hostenol, this TOS supersedes any other agreement with Hostenol, whether written, oral, by conduct, or contrarily.

Server Resources

Any website that uses a high volume of server resources (such as, but not limited to, CPU time, memory usage, and web resources) will be given the possibility to reduce the resources used to an adequate level. Hostenol will be the sole authority of what is considered to be a high server usage level. Any Web Hosting account adversely affecting server performance or network integrity will be shut down without prior notification.

Any script that utilises large amounts of resources is not permitted, such as Proxy scripts, bots, rapid leech scripts, chatting or chat room scripts, file or image hosting scripts, PTC (Paid-to-click) site scripts, mail-bombers or spam scripts, auto-blog scripts and plugins. Such scripts will be fired immediately with no prior warning, and account owners will not be qualified for a refund. We offer shared hosting; therefore, any script you work on that will absorb large amounts of resources negatively affects other clients on your server, so please use common judgment when using a script. If you are uncertain of any script, please contact Hostenol Sales or Support to ensure the script is passed before running the script in your account.

Any account should not practice more than 25% CPU consistently for higher than 5 minutes. If you consistently utilise 25% or more CPU, you will need to upgrade to the next possible hosting plan. Suppose you are using a hosting plan and are still using 25% or more CPU consistently. In that case, you have most likely outgrown a shared hosting ecosystem and should therefore obtain a virtual private server (VPS) or dedicated server that suit your needs adequately.

Any account rejected or terminated due to violation of our Terms of Service will not be qualified for a refund, including during our 30-day money-back guarantee time.

Spam/Bulk Mail

Hostenol has a “No Tolerance” policy for spamming and bulk mailing. Sending undesirable, bulk or commercial messages over the internet or text messaging (known as “spamming”) is forbidden, despite whether it overloads a server or interrupts service Hostenol customers. Hostenol does not allow CAN-SPAM acquiescent bulk email or consider emails, not Spam, because you include an Opt-Out announcement. 

Suppose a Hostenol server IP get blacklisted due to spamming by a users domain name hosted on our servers. In that case, the violator will face immediate termination, and no refunds will be given. Hostenol reserves the power to determine what constitutes a violation of this provision in its sole and absolute responsibility.

Any customer found to be spamming may submit a spam cleanup fee from $200 – $500 depending on the condition and level of cleanup required. Any account rejected or terminated due to spamming will not be qualified for a refund.

Disclaimer of Service Attacks

“Stress experiment” or intentionally receiving DDoS/DoS attacks is not permitted on our servers.

This includes conducting a DDoS/DoS or taking part in a DDoS/DoS from any Hostenol account. Any account discovered actively and knowingly transferring abusive traffic will be instantly suspended and possibly eliminated with no refunds given.

Promoting/Offering/Selling DDoS for hire assistance is not tolerated and will cause direct suspension/termination.

Prohibited Tools:

The following elements are not allowed on our hosting servers:

✘ IRC related items

✘ VPN scripts

✘ Nulled or pirated software

✘ Image or File hosting

✘ Rapid Leech scripts

✘ File sharing applications (including cloud apps, e.g. ownCloud, NextCloud)

✘ Spam or bulk mail scripts

✘ Hacking sites

✘ PTC sites

✘ Sites that promote illegal activity

✘ Sites or forums that connect to and spread prohibited content or copyrighted element

✘ Websites that host or link to copyrighted content without individual permission

✘ Chatroom scripts

✘ Bitcoin miners

✘ Social media (such as Facebook, Instagram, etc.) auto-post or auto-like scripts

✘ Auto-blog scripts or plugins

Inodes

Inodes are the sum of all the files placed on your account. For example, an email saved in your account will be one inode, an email that carries two attachments will be three inodes. Any file, image, video, HTML file, and script file are recognised inodes.

We do not inflict an inode limit but instead offer a “fair usage” policy. If we find the account is practising an abusive quantity of inodes disrupting other customers, we will have no choice but to happen, resulting in the account discontinuing.

Unmetered Bandwidth

Bandwidth usage in our web hosting plan is considered unmetered. We do not restrict bandwidth but rather offering a “fair usage” policy. If we discover the account is using an offensive amount of bandwidth, we will have no choice but to happen, resulting in the account discontinuing. Accounts willingly and intentionally using a gross value of bandwidth will face temporary suspension and termination and will not pass for any refund.

Disk Space Usage

Account disk space is meant for files linked to your websites only. File-sharing or any type of trim or long term storage is not permitted. This also involves using cloud storage purposes such as ownCloud or NextCloud that let you store and distribute files from your hosting account. The use of these applications is not authorised.

Uptime Guarantee

Hostenol guarantees that your site will be up and running at least 99.9% of the time during any given 12-month period. This guarantee holds network uptime, server uptime, web server and service uptime. It does not cover any areas where Hostenol.com has no direct control, such as backbone provider crashes, fibre-optic main line cuts, DNS or Domain Registrar problems with customer's domain name, connection issues between the client's neighbourhood and Hostenol.com data centre. This uptime guarantee is also not suitable if the service delay was affected by external subjects such as Acts of God, Wars or some additional tangible or strange events that Hostenol.com cannot directly touch.

Server Location

Data centre Locations are subject to availability, and choosing a specific location during your order does not guarantee that location. Hostenol holds the right to substitute the server location as necessary and move accounts to other server locations as needed.

Daily Backups

Hostenol operates daily full account backups. This includes the backup of all account information, email accounts and MySQL databases on cPanel. Weekly backups are for Hostenol crash restoration purposes only.

Ownership of Web Site

The legal owner of clients' Web sites and accounts with Hostenol will be the self or organization whose name is registered in the Hostenol database as the purchaser. Buyers will fully cooperate with and abide by all Hostenol security standards and procedures in any dispute over possession of customers' Websites and accounts with Hostenol.

Copyright Violations

DMCA – The Digital Millennium Copyright Act sets ahead of the law concerning the use of copyrighted elements on the Internet. All Hostenol clients are subject to the specifications of the DMCA. Selves or entities submitting notifications of copyright infringement by a Hostenol customer (per the DMCA) to Hostenol must understand the following systems. If you are the subject of a DMCA warning that matches the criteria may be directed to account termination at Hostenol individual consideration.

The DMCA holds precise guidelines as to what proper announcement of claimed violation must include. Copyright owners may receive a copy of the DMCA, including specific procedures, by visiting the official web site of the U.S. Copyright Office at > http://www.copyright.gov/title17/92chap5.html#512.

Hostenol is not required to answer notices that do not meet the conditions of the DMCA. Copyright owners should be informed that there are substantial fines for false claims. Hostenol will actively refer complainants who practice the DMCA for improper directions to relevant law enforcement actions.

Suppose Hostenol must eliminate, or disable access to, the stuff on your web site that is claimed to infringe another's copyright under the DMCA. In that case, you certify and agree that Hostenol may do so by hindering access to your whole web site or terminating your account.

Child Pornography

Hostenol services to collect, post, exhibit, transmit, advertise or otherwise offer available child pornography is prohibited. Hostenol is obliged by law and will notify law enforcement powers when it becomes aware of the appearance of child pornography on, or being conveyed through, its services.

Indemnification

Hostenol clients agree to protect, secure, hold harmless and indemnify Hostenol, any third-party entity associated with Hostenol (including, without interruption, third-party vendors). Hostenol administrators, directors, officers, lawyers, managers, representatives, specialists, entrepreneurs, attorneys, parent companies, subsidiaries, and affiliates, from and against all debts, losses, costs, reviews, damages, demands, or problems of actions, including, without limitation, all legal charges and expenses, standing out of or resulting in any from the customer's use of Hostenol services.

Disclaimer

The Hostenol service is presented on an as-is, as available basis without warranties of any kind, either express or intended, including, but not limited to, warranties of merchantability, suitability for a particular purpose or non-infringement. Hostenol expressly revokes any representation or guarantee that the Hostenol service will be error-free, steady or constant. No verbal advice or printed information given by Hostenol, its employees, licensors or the like will create a guarantee, nor may you rely on anonymous information or opinion. Hostenol and its partners and suppliers will not be responsible for any cost or damage arising either directly or indirectly from any purchase or use of the service.

Modifications

Hostenol may terminate, upgrade, replace, change, or alteration in any way, without limitation, any software, application, program, data, hardware, appliances, or portions or components thereof, used to provide customers with Hostenol services. Specific changes to Hostenol services may influence the operation of customers' personalized applications and content. Each customer is individually responsible, and Hostenol is not liable, for all such customised attention and content, except as expressly granted to by Hostenol.

Backup of Data

Except where Hostenol has expressly agreed in writing to the converse, customers are solely and entirely liable. Hostenol is in NO way responsible for the control and backup of all customer data and all updates, upgrades, and patches to any script that clients use in connection with Hostenol services. Hostenol servers are also NOT to be used as backup storage and is simply for hosting files directly related to your website.

Refusal of Service

We reserve the right to deny, cancel or suspend service at our sole preference. All sub-networks, distributive hosting sites of Hostenol.com must adhere to the earlier policies.

Third-Party Providers

You agree that third-party providers of Hostenol may present specific services and that your use of such services may be directed to further agreements, policies, terms, and conditions in addition to those included or referenced in this Agreement.

Abuse Towards Staff

Hostenol will not permit clients that are abusive towards our staff. This covers but is not limited to: Using aggressive language or frightening a staff member. Hostenol reserves the right to decide what is considered abusive and instantly suspend or, in severe cases, eliminate clients that commit the abuse.

*** Billing Policy ***

The following Terms of Service constitute Hostenol Billing Policy and apply to ALL Hostenol clients:

Payments

All prices are shown in US Dollars. Payments are to be performed in US dollars. Hostenol receives the following sorts of payment:

       ✓ Credit Card (VISA, MasterCard)

       ✓ PayPal

All payments are payable on the Account Statement Date. The Account Statement Date is the monthly festival of the date the account was initiated. Accounts with a recurring payment system such as a PayPal subscription will remain until such time that you cancel your account under Hostenol Billing Policy in the TOS. You are directly accountable for running your recurring payment information up-to-date.

Clients consent to make payment of their balance due within three (3) days of the Account Statement Date.

All hosting accounts are due on the date scheduled. If not paid on the due date, the server will be deactivated automatically and listed to be formatted and redeployed.

Grace Period

Accounts that are three (3) days before due will be automatically suspended, and after reaching (15) days past due, are automatically terminated. If your account is terminated for non-payment, all files and databases related to the account are deleted and are not retrievable. All past due and outstanding balances are subject to collection of payment. You will be liable for finding costs in the group event, including court costs, attorney's fees, and collection agency fees.

Upgrading/Downgrading

Our hosting plans can be upgraded/downgraded at any time from our client area to any qualifying plan. Special offer does not support downgrades, so if a promotional code is working on the account, it will be lost when operating any downgrade. Once separated, the promotional code cannot be re-added, so please be sure of your decision to downgrade your account's plan.

Overpayments

Any overcharges made to your account will be automatically added to your accounts credit balance and are considered non-refundable.

Account Renewals

To ensure continuous service to your website, all plans will automatically renew at the end of the plan's Billing Period. According to the service selected, plan renewal charges are based on the current rate on the renewal date. Plans are renewed for the corresponding billing cycle. If you wish to discontinue your plan before the renewal date, please refer to the Cancellation section below.

Statements

Hostenol does not send mail paper invoices or receipts. All reports are sent via email as an invoice due notification. The client is responsible for securing a valid, working contact email address at all times to receive such messages. Reports can also be viewed and printed through our client area: https://my.hostenol.com.

30 Day Money Back Guarantee

Each of Hostenol hosting plans provides a 30-day money-back guarantee. If you are not solely satisfied with our services or guide within the first 30 days, you will be granted a full refund. Refunds will not be assigned for the sole purpose of using our assistance in a “Free Trial” manner or for “buyers regret”.

The following services and circumstances do not qualify and can perform the 30 Day Money Back Guarantee void: 

(a) Server Management Services, Domain name listing/transfers/renewals, SSL certifications, software licenses, add-on services, and setup are not covered in the 30-day money-back guarantee. 

(b) Illegal activity was directed or indicated on our servers will also void this contract. 

(c) This request must be sent in 5 business days (excluding weekends/holidays) before the first 30 days to be prepared and qualified. 

(d) If you ordered multiple hosting plans, this guarantee would only apply to one hosting package, the first one you remove.

Refund Policy

Refunds are only possible under the 30 Day Money Back Guarantee. Payments will be provided in the same payment method as the original payment. There are no returns offered or promised after 30 days despite the billing cycle used, and no prorated refunds for any additional time will be given. Hostenol has complete jurisdiction in the knowledge of providing refunds for our promotional offers.

We also own the right to withhold any payment processing fees when issuing refunds.

Credit Card Disputes/Chargebacks

Hostenol has an absolute 0 tolerance policy for chargebacks. Any customer who disputes a credit card payment is subject to a fine, discontinuing and account termination at Hostenol consideration. A charge of around $50.00 per chargeback will be assessed to all accounts that hold a chargeback.

Billing/Price Changes

Hostenol plans and prices are subject to change without notice. Any rate changes become active in the next billing cycle.

Hostenol holds the right to update the Terms of Service (TOS) without prior notification, and no warranties shall be implied or addressed.
